Depending on how you interact with Barry Henderson Photography, information may include your name, contact details, enquiry and booking details, session location, correspondence, transaction information, delivery details, photographs, gallery selections, print orders and publication permissions.
Why Information Is Used
Personal information may be used to respond to enquiries, arrange and manage photography sessions, process payments, provide private galleries and digital photographs, fulfil print orders, maintain appropriate business records, deal with complaints and protect the operation of the website.

Information necessary to arrange and provide a photography service is generally processed because it is required to enter into or perform a contract.

Photographs
Photographs containing identifiable people may constitute personal data. They may be processed for professional selection, editing, gallery delivery, print fulfilment and completion of the photography service.
Booking a session does not automatically give permission for identifiable client photographs to be published for marketing.
Public Event Photography
Barry Henderson Photography may photograph public events such as agricultural shows, country shows and similar events where photography forms part of normal event coverage. Photographs may include identifiable people, participants, competitors and spectators.
Where appropriate, photographs from public events may be selected, edited, archived and published as part of event coverage, professional portfolio work or promotion of Barry Henderson Photography on the website or social-media channels. This processing may be based on legitimate interests where those interests are not overridden by the rights and interests of the people photographed.
Particular care will be taken with photographs of children and young people, sensitive circumstances and situations where publication would not reasonably be expected. Anyone with concerns about an identifiable photograph of themselves or a child for whom they are responsible may contact Barry Henderson Photography. Requests and objections will be considered in accordance with the individual's applicable data-protection rights.
Portfolio & Promotional Permission
Clients may separately be asked for permission to use selected photographs on the Barry Henderson Photography website, portfolio or social-media channels.
Permission is optional and declining it will not affect price, booking or service.
Children & Young People
Appropriate parent or guardian permission will be obtained before identifiable photographs of children or young riders are published for promotional purposes.
Sharing Information
Personal information is shared only where reasonably necessary to provide the service, operate the website, fulfil an order, meet a legal obligation or protect legitimate business interests.
This may include the website hosting provider, Square for payment processing, professional print laboratories, postal or delivery services, email or communication services, professional advisers and public authorities where disclosure is legally required.
Client galleries are operated through the Barry Henderson Photography website rather than through a separate third-party gallery platform. Gallery information, previews and authorised downloads may therefore be stored and processed on the website hosting system.
Barry Henderson Photography does not sell client personal information to advertisers.
Payments
Online payments and checkout services may be processed by Square. Where Square handles a payment, relevant transaction information is processed through Square's payment systems.
Barry Henderson Photography does not need to collect or retain full payment-card details where those details are handled directly by Square.
Retention
Personal information is not retained for longer than reasonably necessary for the purpose for which it was collected. How long information is kept depends on what it is and why it is needed.
Enquiry information that does not lead to a booking is kept only for a reasonable follow-up and business-record period. Booking, transaction and accounting records are retained for as long as required for relevant tax, accounting and legal obligations.
Private proof galleries are provided for client selection and are not intended to remain available indefinitely. The normal client selection period is 21 days.
Finished photographs and photographic working files may be retained for archive, backup, client-service and legitimate business purposes while there remains a reasonable need to keep them. Retention is reviewed having regard to those purposes, storage requirements and the rights of the people concerned.
Records of portfolio or promotional permission may be retained for as long as reasonably necessary to demonstrate the permission applying to the relevant use. Complaint or dispute information may be retained for as long as reasonably necessary to resolve the matter and manage potential legal claims.
Security
Reasonable technical and organisational measures are used to protect personal information and photographic files from unauthorised access, accidental loss, alteration or disclosure.
Your Rights
Depending on the circumstances and lawful basis involved, you may have rights including access, correction, erasure, restriction, objection, portability and withdrawal of consent where consent is relied upon.
You have the right to object to processing based on legitimate interests in circumstances where that right applies.

Barry Henderson Photography does not currently use Google Analytics, Meta Pixel, Microsoft Clarity or similar advertising or behavioural analytics tracking on the main public website.
If non-essential analytics, advertising or similar tracking technologies are introduced in the future, this notice and the website's consent arrangements will be updated where required.
