Terms & Conditions

These Terms & Conditions apply to photography services, photographs, digital downloads, galleries and prints supplied by Barry Henderson Photography.

Specific booking, payment, cancellation, postponement, travel and event arrangements are also covered by the Booking Terms.

Current package prices, included photographs, print options, additional images and travel charges are shown on the Pricing page.

Larger, more complex or unusual commissions may be quoted individually. Any additional work or charges outside the original booking will be agreed where reasonably possible before that work is undertaken.

Copyright in photographs created by Barry Henderson Photography remains with Barry Henderson Photography unless expressly agreed otherwise in writing.

Purchasing a photography service, digital photograph or print does not transfer copyright.

Digital photographs supplied from private sessions or purchased by event attendees are licensed for personal use.

Personal-use photographs may be downloaded, stored, displayed privately and shared on personal social-media accounts.

They must not be sold, licensed, used for business or commercial purposes, supplied to another organisation for commercial use, or used to create products for sale without separate permission.

The organiser-selected photographs included with a Half-Day or Full-Day Event package are supplied with a commercial and promotional licence for the organiser's own use.

This includes use on the organiser's website, organic social media, brochures, posters, press material and general publicity.

Unless separately agreed, the licence does not include paid advertising, resale, merchandise, sublicensing or supplying the photographs to sponsors, exhibitors or other third parties for their own commercial use.

Additional organiser commercial images purchased for the event are supplied under the same commercial and promotional licence as the organiser's included selected images unless separately agreed.

Copyright remains with Barry Henderson Photography.

Photographs are selected and edited in the established style of Barry Henderson Photography. The final selection, colour treatment, cropping and general editing approach remain part of the photographer's creative judgement.

Extensive manipulation, specialist retouching or other work outside normal editing may be quoted separately.

RAW files, camera-original working files and otherwise unprocessed photographs are not supplied. The finished edited photographs are the final photographic product.

Standard and Extended Sessions include a private online gallery for viewing, selection and delivery as part of the applicable package. Half-Day and Full-Day Event packages include a private organiser selection gallery. Clients and organisers are responsible for keeping their private gallery access details private.

Where a gallery includes a final-selection facility, the client or organiser should check the selection carefully before submitting it. A submitted final selection may be locked and treated as complete.

Standard Sessions include 5 edited digital photographs and Extended Sessions include 10 edited digital photographs.

Half-Day Event organisers may select 20 edited photographs and Full-Day Event organisers may select 40 edited photographs.

Additional photographs may be purchased at the prices shown on the Pricing page.

Standard and Extended Sessions include one professional 8×6 print. The client selects the photograph for the included print after reviewing the proof gallery.

If the selected photograph is unsuitable for an 8×6 crop, Barry will discuss an appropriate alternative print format rather than force an unsuitable crop.

Print sizes and current prices are shown on the Pricing page. Print orders must be paid for before they are ordered from the professional print supplier.

Printed photographs can vary slightly in colour and brightness from images viewed on different screens because displays, papers and print processes reproduce colour differently.

Royal Mail tracked delivery is available at the price shown on the Pricing page. Customer collection is available free of charge by arrangement.

Print production and delivery are normally expected to take approximately 7–10 working days once the required print selection and order details are confirmed and the order has been placed with the print supplier. Supplier or postal delays can occasionally occur.

If a supplied print is damaged, defective or incorrect, or if an incorrect digital file has been supplied, Barry Henderson Photography will investigate and arrange an appropriate correction or replacement where the problem is confirmed.

Customers should report any problem as soon as reasonably possible and provide sufficient information to identify the affected order.

Most private-session orders are completed in approximately 2–4 weeks, but this timeframe depends on the client making their required gallery, image and print selections promptly. Delayed selections may extend the overall completion time beyond four weeks.

Clients are asked to make their required gallery selections within 21 days of the proof gallery being made available.

Where appropriate, an attendee event gallery may be provided. Where provided, it will normally remain available for 90 days after publication.

Finished photographs may remain archived afterwards and later enquiries or orders may sometimes be possible, but permanent archival storage is not guaranteed.

Website content, photographs, branding and other original material must not be copied, reproduced, republished or commercially exploited without permission except where permitted by law or by an applicable photograph licence.

Reasonable personal browsing, linking to public pages and use of photographs in accordance with an agreed licence are permitted.

Some services may depend on third parties such as hosting providers, print laboratories, delivery companies or other suppliers. References to payment services apply only if a payment provider is used for the particular transaction. Barry Henderson Photography is not responsible for matters wholly outside its reasonable control, but will take reasonable steps to resolve problems affecting an order or service where possible.

Reasonable care is taken to keep the website and online galleries available and secure, but uninterrupted access cannot be guaranteed. Temporary maintenance, technical faults, supplier outages or other circumstances may occasionally affect availability.

Barry Henderson Photography will take reasonable care in providing photography services and supplied products.

Nothing in these terms excludes or limits liability where it would be unlawful to do so, or affects statutory rights that cannot lawfully be excluded or restricted.

Subject to those rights, Barry Henderson Photography is not responsible for losses caused by circumstances outside reasonable control or for indirect business losses arising from personal-use photography services.

Where Barry and the client or organiser agree a specific written change for an individual booking, that agreed change will apply to that booking where it differs from these general terms.

These terms and any dispute or claim arising from them are governed by the laws of England and Wales, subject to any mandatory rights or legal protections that apply to the customer.
